Do All Cookies Require User Consent?
Not all cookies require consent from users. Essential cookies, which are necessary for a website to function properly, such as those enabling login, shopping cart use, or e-billing are exempt from consent requirements. These cookies are deemed necessary for delivering a service that the user has explicitly requested.
However, cookies that serve other purposes, such as tracking or analysing user behaviour, do require prior consent. To comply with the regulations, website owners must notify users about the cookies in use, explain their purpose, and obtain consent before placing them on the user's device. This process only needs to be repeated if there are changes in cookie usage or if the device is shared by multiple users. The rules also apply to similar technologies like Flash cookies or apps on devices and prohibit tracking software that operates covertly, such as spyware which secretly collects information.
